3. Conclusion of the Purchase Agreement and Orders

The presentation of goods on the website is for informational purposes only and does not constitute an offer to conclude a contract within the meaning of Section 1732(2) of Act No. 89/2012 Coll., the Civil Code (hereinafter the “Civil Code”). The purchase agreement is concluded once the seller confirms the buyer’s order by email to the address provided in the order.
The seller reserves the right to رفض an order, especially due to stock depletion or a technical pricing error. In such case, the buyer will be informed without undue delay.
The contract is archived electronically. Upon request, the seller will provide it to the buyer.

4. Prices and Payment Terms

All prices are stated in Czech crowns (CZK) and are final. The seller is not a VAT payer.
Available payment methods:

  • Bank transfer to the seller’s account (account number provided in the order confirmation).

  • Online card payment via Shopify Payments.

  • Cash / payment card upon personal pickup.

Goods are dispatched after payment has been credited to the seller’s account, unless agreed otherwise.

5. Delivery Terms and Shipping

The seller usually dispatches standard in-stock goods within 3–5 business days after order confirmation and receipt of payment.
For custom-made goods — golf clubs built to measure (custom build / custom fit) — the delivery time is individual and depends on component availability. Typically, it ranges from 10–21 business days. The buyer is informed of the delivery time before order confirmation.
Available delivery methods and their prices are shown in the cart. Risk of damage passes to the buyer upon receipt of the shipment from the carrier.
Upon receiving the shipment, please check the integrity of the packaging. If damage is discovered, prepare a report with the carrier and contact us at petr@primefitting.cz.

6. Right of Withdrawal

6.1 Statutory Consumer Right (§ 1829 Civil Code)

A buyer-consumer (a natural person acting outside the scope of their business activity) has the right to withdraw from a distance contract without giving any reason within 14 days from the date of receipt of the goods.

6.2 Exception: Made-to-Order Goods (§ 1837(d) Civil Code)

⚠️ The right of withdrawal does not apply to goods made or modified according to the buyer’s individual specification. This includes in particular:

  • golf clubs built to measure based on the buyer’s fitting data,

  • shafts cut and bonded according to an individually specified length,

  • clubs with personalized print or engraving,

  • grips installed according to the buyer’s specified thickness / tape build-up.

The buyer is informed of this limitation before submitting the binding order.

6.3 Procedure for Withdrawal

Send the seller a clear statement of withdrawal by email to petr@primefitting.cz or by post to the registered office address.
Return the goods no later than 14 days after sending the withdrawal notice, unused, in their original or equivalent packaging, ideally with proof of purchase.
The direct cost of returning the goods is borne by the buyer.
The seller will refund all payments received, including the cost of standard delivery, within 14 days of receiving the withdrawal notice, but no later than after receiving the returned goods.

6.4 Model Withdrawal Form

7. Complaints Policy

7.1 Rights from Defective Performance (§ 2161 et seq. Civil Code)

The seller is liable to the buyer-consumer for ensuring that the goods are free from defects upon receipt. If the buyer discovers a defect within 2 years of receipt, they are entitled to file a complaint.
A buyer-entrepreneur exercises rights from defective performance under § 2099 et seq. of the Civil Code; conditions may differ and are specified individually.

7.2 How to File a Complaint

Contact the seller at petr@primefitting.cz or in person.
Please include the order number, a description of the defect, and photo documentation.
The seller will confirm receipt of the complaint and issue a written confirmation stating the date of filing and the method of handling.
The complaint will be resolved no later than 30 days from the date it was filed (§ 19 of Act No. 634/1992 Coll.).

7.3 Warranty Exclusions

The warranty does not cover: wear and tear caused by normal use (grips, leading edges of wedges, surface coatings), damage caused by improper handling or storage, unauthorized modifications to the club construction, or damage caused during transport if caused by the buyer.

8. Personal Data Protection (GDPR)

Customer personal data are processed solely on the basis of:

  • performance of the purchase contract and pre-contractual relations (Article 6(1)(b) GDPR),

  • compliance with a legal obligation – accounting and tax records (Article 6(1)(c) GDPR),

  • legitimate interest of the seller – customer communication and rights protection (Article 6(1)(f) GDPR).

Data are not transferred to third parties except for: the shipping company necessary for delivery; the payment gateway provider; the Shopify platform (processor – USA, protection ensured by EU Standard Contractual Clauses).
Personal data are retained for the duration of the contractual relationship and for the period required by law (accounting documents 5–10 years).

Your Rights

You have the right to: access your personal data (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), and the right to object (Art. 21). Requests should be sent to petr@primefitting.cz. A complaint may be filed with the Office for Personal Data Protection (www.uoou.cz).

Cookies

The Shopify-based e-shop uses technical cookies necessary for cart functionality and session security. Analytical or marketing cookies are used only with the visitor’s consent (§ 89 of Act No. 127/2005 Coll., ePrivacy Directive). Consent may be withdrawn at any time via the consent banner on the website or by browser settings.

9. Out-of-Court Consumer Dispute Resolution (ADR / ODR)

In the event of a dispute that cannot be resolved by agreement, the consumer may use out-of-court dispute resolution (§ 20d of Act No. 634/1992 Coll.):

The seller reserves the right to refuse participation in out-of-court dispute resolution but will always seek an amicable solution through direct communication.

10. Final Provisions

Legal relations between the seller and the buyer are governed by the law of the Czech Republic, in particular Act No. 89/2012 Coll. (the Civil Code) and Act No. 634/1992 Coll. (on Consumer Protection). For any court disputes, the competent court shall be the seller’s general court.
If any provision is or becomes invalid or ineffective, this does not affect the validity of the remaining provisions.
This legal notice is valid and effective from 24 May 2026. The seller reserves the right to update the content unilaterally; changes take effect upon publication on the website.
